TEST This Act provides for the health and safety of persons at work and for the health and safety of persons in connection with the use of plant and machinery. It also provides for the protection of persons other than persons at work against hazards to health and safety arising out of or in connection with the activities of persons at work.
This section states that every employer is obliged to provide and maintain a working environment that is safe and without risk to the health of his employees. It also lists a series of specific duties of employers aimed at assisting with the achievement of this requirement.
Compliance Obligations?
In order to comply with this section, the implication is that you would have to conduct a hazard identification and risk assessment of all the activities that are found at your work place, so that the hazards and risks to health and safety are identified and properly understood. Once understood, measures must be implemented to eliminate, avoid or mitigate these risks. Note the employer’s specific duties under sections 8(2)(a)-(j).
This section sets out the various duties that employers have to inform employees and health and safety representatives in regard to health and safety hazards, inspections, investigations, formal inquiries and incidents.
Compliance Obligations?
Ensure that employees understand the hazards to their health and safety attached to any work that they have to perform. Ensure that health and safety representatives are advised of inspections, investigations and formal enquiries before they take place. Inform health and safety representatives as soon as reasonably practical of any incidents that occurred in the workplace or section of workplace for which that health and safety representative has been designated.
