OHSA: PRESSURE EQUIPMENT REGULATIONS AS PUBLISHED UNDER GN R.734 IN GG 32395 OF 15 JULY 2009

SUMMARY

These regulations regulate pressure equipment and activities associated with such equipment.

REGULATIONS THAT MAY APPLY TO YOU

Regulation 2: Scope of Application

This regulation sets out the applicability of the regulations to certain types of equipment.

Compliance Obligations?

The Regulations apply to the design, manufacture, operation, repair, modification, maintenance, inspection and testing of pressure equipment with a design pressure equal to or greater than 50 kPa. Note the list of pressure equipment which is excluded from the Regulations as set out in subsection (3)(a) – (h). Further note the definitions of “pressure equipment” and pressure vessel” in the definitions section of the Regulations.

Regulation 3: General Requirements

This regulation stipulates what the general requirements are with regard to pressure equipment.

Compliance Obligations?

Any person who manufactures, imports, sells, offers or supplies any pressure equipment must ensure that the equipment complies with these regulations.

Any person who erects or installs any pressure equipment must ensure that it is erected or installed in a safe manner and without risk to the health and safety of the employees when it is used.

All pressure equipment must be categorised and submitted to the applicable conformance assessments of SANS 347 in addition to the requirements of the relevant health and safety standards.

Regulation 4: Duties of Manufacturers

This regulation regulates the duties of manufacturers.

Compliance Obligations?

If you manufacture pressure equipment you must ensure that it is designed and manufactured in line with the requirements of SANS 347. You must further ensure that the pressure equipment is safe and without risks to health when properly used.

Regulation 5:Duties of Importers and Suppliers

This regulation regulates the duties of importers and suppliers.

Compliance Obligations?

Importers and suppliers must ensure that pressure equipment sold complies with the requirements of these Regulations.

The importer shall assume the liability of the manufacturer in terms of these Regulations.

Any pressure equipment that requires a permit to be issued by an organisation approved by the chief inspector must ensure that the approval of such permit is obtained by the importer or manufacturer prior to placing the pressure equipment on the market. Note that the equipment must comply with the applicable health and safety standard incorporated into these Regulations under Section 44 of the OHSA.

Regulation 6: Duties of Users

This regulation sets out the duties of users of pressure equipment.

Compliance Obligations?

As a user you must ensure that pressure equipment is operated and maintained within its design and operating parameters.

You must provide the manufacturer, repairer or modifier of information relating to the operating or intended operating conditions and ensure the pressure equipment has a certificate issued by the manufacturer which certifies that it has been designed and manufactured in accordance with the relevant health and safety standard incorporated into the Regulations.

You must have a certificate issued by an approved inspection authority (“AIA”) before commissioning and ensure that if you have a gas system that it has a valid certificate issued by an authorised person.

Regulation 7:Approval and Duties of Approved Inspection Authority

This regulation regulates the approval and duties of approved inspection authority.

Compliance Obligations?

Only an organization holding an approval certificate from the chief inspector shall perform the duties of an approved inspection authority.

An application for approval must include the applicant’s proof of accreditation as prescribed by Regulation 7(3)(a) or 7(3)(b).

The chief inspector’s approval must comply with Regulation 7(3)(a) or 7(3)(b).

Imported pressure equipment stamped by an ASME authorised manufacturer will be deemed to comply with the requirements of these Regulations.
In the event of a dispute of a technical or safety issue refer to Regulations 7(5) – 7(8).

Regulation 8: Registration of a Stream Generator

This regulation regulates the registration of steam generators. Note the definition of “steam generator” in the definitions section of the regulations.

Compliance Obligations?

You may only use a steam generator if you are in possession of a certificate of registration and in line with the conditions of such registration.

You must notify the provincial director when a steam generator is no longer in use; the right of control has been transferred to another user; or if you move the steam generator to premises other than those premises reflected on the certificate of registration.

Regulation 9: Pressure Equipment Marking

This regulation regulates pressure equipment marking.

Compliance Obligations?

Manufacturers must ensure that all pressure equipment is marked in accordance with relevant health and safety standard incorporated into the Regulations.
A data plate must be permanently affixed in a conspicuous place to any steam generator or pressure vessel. The data plate must at least contain the details set out in sub-regulation (2)(a) – (j). Note the definition of “pressure vessel” in the definitions section of the regulations.

Regulation 10: Pressure And Safety Accessories

This regulation regulates pressure and safety accessories.

Compliance Obligations?

If you are the user of pressure equipment, you must ensure that the equipment is provided with all the pressure and safety accessories required by the relevant health and safety standard incorporated into the regulations.

Steam generators must be fitted with at least one pressure measuring device and steam generators and pressure vessels must be fitted with at least one safety valve which must be kept locked, sealed or otherwise inaccessible to any unauthorised person.

Regulation 11: Inspection and Test

This regulation regulates the inspection and testing of pressure vessels and steam generators.

Compliance Obligations?

Steam generators or pressure vessels, including pressure and safety accessories, after they are installed or reinstalled and before they are commissioned must be subjected to a witnessed internal and external inspection of a hydraulic pressure test to 1.25 times the design pressure by an AIA. Note that this can be dispensed with if the testing will have an adverse effect on the operation or integrity of the pressure equipment. You will have to obtain written approval from the AIA to dispense of the test.

Fire-tube steam generators must be subjected to an external inspection every 12 months and a witnessed hydraulic test and crack detection of critical welds every 36 months by an AIA.

All pressure vessels and steam generators must be subject to an internal and external inspection and hydraulic pressure test to a pressure of 1.25 times the design pressure by an AIA at intervals not exceeding 36 months. Note that if the pressure equipment is not subject to deterioration processes, you may dispense with the testing for a maximum period of nine years with written approval of an AIA.

Regulation 12: Risk-Based Inspection

This regulation allows a user to implement a risk-based inspection management system as an alternative to the in-service inspection and testing interval system.

Compliance Obligations?

If you wish to implement a risk-based inspection management system instead of complying with the inspection requirements, it must be done in accordance with the relevant health and safety standard and verified by a certification body accredited by the accreditation body in terms of ISO 17021.

Regulation 13: Repairs and Modifications

This regulation regulates repairs and modifications to pressure equipment.

Compliance Obligations?

If you require re-certification of any pressure equipment you must ensure that it is performed under the supervision of an AIA.

Regulation 14: Records

This section regulates the keeping of records.

Compliance Obligations?

You must keep records of all inspections, tests, modifications and repairs.

Regulation 15: Access

This regulation regulates access to pressure equipment.

Compliance Obligations?

You must ensure that all your pressure equipment is erected and maintained in such a manner that access to and exit from any chamber, flue, manhole, inspection opening, control or accessory is safe an unobstructed.

Regulation 17: Gas Reticulation Equipment and Systems

This regulation regulates gas reticulation systems and equipment. Note the definition of “gas system” in the definitions section of the Regulations.

Compliance Obligations?

You must handle and store gas in accordance with the relevant health and safety standard. Only authorised persons may remove a gas appliance, gas system or gas reticulation system.

After installation or re-installation and before commissioning a gas system, you must ensure an external inspection and leak test is performed by an authorised person or AIA.

Regulation 18: Transportable Gas Containers

This regulation regulates the use, filling, placing into service, handling, modifying, repairing, inspecting and testing of transportable gas containers.

Compliance Obligations?

All of the above must be completed in accordance with the relevant safety standards. Inspections must be carried out by an approved testing station.

Regulation 19: Fire Extinguishers

This regulation regulates the use of fire extinguishers.

Compliance Obligations?

You may only use a fire extinguisher if it has been designed, constructed, filled, recharged, reconditioned, modified, repaired, inspected or tested in accordance with the relevant safety standards.

Only a person employed by a permit holder may fill, recharge, recondition, modify, repair, inspect or test a fire extinguisher.
