FIRE BRIGADE SERVICES ACT 99 OF 1987

SUMMARY

This Act provides for the establishment, maintenance, employment, co-ordination and standardization of the fire brigade service.

SECTIONS OF THE ACT THAT MAY APPLY TO YOU

Section 8: Powers of Members of Service

This section empowers members of the fire brigade service to perform various acts whenever they are deemed necessary or expedient in order to properly perform their functions under this Act.

Compliance Obligations?

Members of the service may close roads, enter or break and enter into any premises, destroy, damage or pull down any property, forcibly remove persons who are in danger or who obstruct them in the completion of their duties, and they may remove material or objects from any person. Ensure that in the event of a fire emergency, you comply and co-operate with the Chief Fire officer and his staff.

Section 17: Failure to Comply with Requirements

This section sets out the steps that may be taken by the competent authority to enforce compliance with the provisions of this Act and any regulations made under it.

Compliance Obligations?

If you fail to comply with a standard, requirement or direction determined or issued under the Act or the regulations contemplated in section 15, the Minister may direct you in writing to comply within a period specified in the compliance notice. If you do not, the Minister may take steps to ensure compliance and recover the costs of so doing from you. Before such steps are taken, the Minister must consult you.

Section 18: Enforcement of Provisions

This section gives the Chief Fire Officer certain powers to enforce the provisions of this Act.

Compliance Obligations?

The Chief Fire Officer may enter any premises at any reasonable time to determine whether you have complied with the regulations referred to in section 15. Note compliance with {sections 15(1)(a),(d),(e), and (g)}[https://registers.ecoimpact.co.za/Link/externalLinks/bookmark/36776_476] and 16 are relevant. If there is non-compliance, you may be issued with a compliance notice ordering compliance within a specified time. If there is still no compliance, the controlling authority may take such necessary steps to ensure compliance and recover the costs of doing so from you.

Section 20: Indemnity

This section gives the controlling authority, the Chief Fire Officer and members of the fire brigade service an indemnity against damages or claims for loss if these were caused in the proper execution of their duties in terms of this Act.

Compliance Obligations?

If damage or loss as a result of bodily injury, loss of life or loss of or damage to property was caused in connection with any bona fide conduct in accordance with the provisions of this Act, the regulations contemplated by section 15 or a by-law contemplated by section 16, the Chief Fire Officer and members of the fire brigade service, as well as individuals referred to in section 8(2) (persons older than 16 but younger than 60 ordered to assist) are fully indemnified.
