EKURHULENI METROPOLITAN MUNICIPALITY: WATER SUPPLY BY-LAWS

SUMMARY

This by-law mainly provides for the provision, management and regulation of water supply within the municipal area of the municipality.

SECTIONS OF THE BY-LAW THAT MAY APPLY TO YOU

Section 2: Council's Sole Right To Supply Water From Water Main

This section provides the Council with the sole right to supply water from water mains.

Compliance Obligations?

You may not obtain the supply of water or take any water from a water main other than by means of a water connection provided by the Council pursuant to a service agreement concluded in accordance with the provisions of these regulations.

Section 5: Unauthorized Use Of Water

This section requires written permission to use mains water.

Compliance Obligations?

You may not take any water from or make or cause to be made any connection with any main, standpipe, reservoir, hydrant, conduit pipe, cistern or other place containing water belonging to the Council except, when written permission has been obtained from the Council.

Section 33: Water Audit

This section sets out the requirements for annual water audits.

Compliance Obligations?

If you use more than 3 650 kl of water per year, you must, within one month after the end of each financial year of the council undertake an annual water audit at your own cost.

A copy of the audit must be available for inspection by officials from the Department of Water Affairs and Forestry, the Water Board and the Council.

This section sets out in detail what information should be included in the audit report. In this regard see section 33(3) (a)-(i).

Section 34: Waste Of Water

This section forbids the waste of water.

Compliance Obligations?

You may not permit the purposeless or wasteful discharge of water from any water installation and/or water main, the use of maladjusted or defective water installations or an overflow of water to persist.

Section 37: Prevention Of Wasteful Discharge Or Overflow of Water

This section forbids the wasteful discharge or overflow of water.

Compliance Obligations?

You must ensure that water fittings that form part of a water installation on your premises as well as the primary overflow from any water-closet cistern is installed in such a position and in such a manner that any discharge of water therefrom will be readily visible and will not directly enter into a sewer or a storm water system.

Section 39: Metering Devices For Taps And Showers

This section requires the installation a various water use limiting devices with the aim to prevent the unnecessary use/waste of water.

Compliance Obligations?

Each wash basin in a battery of three or more on any premises, other than residential premises, shall be fitted with a metering type of tap which limits the discharge of water in each usage to not more than 1 litre per operation.

Each shower in a battery of showers of two or more on any premises, other than residential premises, shall be fitted with a metering valve which limits the discharge of water in each usage to not more than 2,5 litres per operation.

The maximum discharge rate of water of any showerhead installed on any premises, including residential premises, shall not exceed 10 litres per minute under maximum flow conditions.

Section 43: Pollution Of Surface Water

This section seeks to prevent the pollution of surface water.

Compliance Obligations?

You may not throw any rubbish, night soil, excreta, industrial waste, chemical substance, oil, dirt, filth, or other deleterious matter into such stream, reservoir, aqueduct, or other place within the catchments of a surface dam.

You may not cause or permit the water from any sink, sewer, drain, engine, boiler or any other polluted water or liquid or oil for the control of which you are responsible, to run or be brought into any stream, reservoir aqueduct, or other place or do any other act whereby the supply of water to the inhabitants of the Council's area of supply may be polluted.

Section 45: Obligation Of Owner To Prevent Pollution Of Water

This section places an obligation on the owners of premises to prevent pollution of the water supply system.

Compliance Obligations?

You must provide and maintain approved measures to prevent the entry of any substance which may be a danger to health or adversely affect the potability of water into the water supply system of the Council or any part of the water installation on your premises.

Section 51: Measures To Prevent Development Of Bacterium Legionella Pneumophila

This section requires measures to be put in place to prevent the development of bacterium Legionella pneumophila.

Compliance Obligations?

You must ensure that every new water installation complies with the requirements set out in paragraph 7.1.1.2 of SABS 02521:1994.

You must, at intervals not exceeding 90 days reckoned from the date of commencement of these regulations or the date of installation, whichever is applicable, cause every potable water storage or air conditioning installation and every such system to be inspected by a professional engineer to evaluate such installation for conditions conducive to the development of bacterium Legionaella pneumophila.

The engineer that you employ should provide you with a written report of his findings and state whether or not the requirements referred to in subsection 51(1) are being complied with and, where applicable, particulars of any noncompliance with those requirements.

You have 14 days from the date of receipt of the report to rectify the non-compliances listed therein.

Section 63: Leakage Of Taps Or Pipes

This section forbids leaking taps and/or pipes.

Compliance Obligations?

You should ensure that a procedure is in place to regularly monitor taps and pipes to check for any leaks.

Section 7: Application for supply of water

This sections details the requirements for the application for supply of water.

Compliance Obligations?

No person shall gain access to water from the water supply system, unless he or she applied to the Council on the prescribed form for such service for a specific purpose and to which such application has been agreed.

Section 13: General conditions of supply

This section sets out the general conditions of supply.

Compliance Obligations?

The provision of a water connection by the Council for the supply of water shall not constitute an undertaking by it to maintain at all times or at any point in its water supply system an uninterrupted supply of water, a specific pressure or rate of flow in such supply or a specific standard or quality of water.

Section 71: Provision of water connection for fire-fighting purposes

This section sets out the provision of water connection for fire-fighting purposes.

Compliance Obligations?

The Council may, where a special agreement therefor has been concluded with the owner of any premises under Section 83, provide a water connection on a water main for the purposes of any fire extinguishing installation on such premises, subject to the provisions of this Chapter.
