CITY OF JOHANNESBURG METROPOLITAN MUNICIPALITY: WATER SERVICES BY-LAWS 2023

SUMMARY

These by-laws regulate the provision of water, sewerage disposal and sanitation services in the area of jurisdiction of the City of Johannesburg Metropolitan Municipality.

Section 5: Application For Water Services

This section regulates when and how applications for water services should be made

Compliance Obligations?

No access to water services provided from the water supply system of the Municipality is permitted unless an application has been made to the municipality in the prescribed form.

Section 18: Unauthorised Use Of Water Services

This section prohibits the unauthorised use of water services and sets out the steps that the Municipality may take to rectify unlawful use.

Compliance Obligations?

Access to the water services from a water supply system is forbidden unless an agreement for this has been entered into with the Municipality.

Section 20: Interference With Water Supply System Or Any Sanitation Services

This section explains who shall manage, operate and maintain a water supply system or sanitation service.

Compliance Obligations?

Only the municipality may manage, operate and maintain a water supply system or sanitation service. If you wish to conduct any of the above mentioned activities or dump or release any substances into the sewer disposal system, you must obtain the permission of the Municipality to do so.
Only the municipality may affect connections to the system and render sanitation services.

Section 43: Owner To Prevent Pollution Of Water

This section seeks to prevent the pollution of water by requiring owners to provide and maintain measures to prevent the entry of a substance which may be a danger to health or the environment or adversely affect the potability of water.

Compliance Obligations?

You must put measures in place to ensure that no substance which may be a danger to health or the environment or which may affect the potability of water may enter the water supply system; any part of the water installation on your premises; the storm water system; sewage disposal system or the environment.

Section 60: Wastage of Water Unlawful

This section prohibits the waste of water.

Compliance Obligations?

You may not allow the discharge of water from terminal fittings or permit such discharge, permits pipes and water fittings to leak, permit an overflow to persist or allow inefficient use of water.

Section 71: Permission To Use Water For Drinking Purposes From Source Other Than Water Supply System

This prohibits the use of water from sources other than for the water supply system or rain tanks connected to the water installation and grey water.

Compliance Obligations?

If you wish use water from a source other than from the water supply system or rain tanks connected to the water installation, you must obtain the permission of the council to do so.

Section 80: Application for Disposal of Industrial Effluent

This section prohibits the discharge of industrial effluents into the sewage disposal system without the permission of the Municipality.

Compliance Obligations?

If you wish to discharge any industrial effluent into the sewage disposal system you must apply in writing on the form prescribed in Schedule C for written permission from the Municipality to do so.
Once you have received permission, you must ensure that the effluent you discharge complies with the requirements of the permit at all times.

Section 81: Unauthorised Discharge of Industrial Effluent

This section prohibits the discharge of industrial effluents into the sewage disposal system except in terms of the written permission of the municipality.

You must ensure that you comply with the conditions of your permit at all times.
