GAUTENG PROVINCE: NOISE CONTROL REGULATIONS

These regulations provide a minimum standard for noise regulation and introduce new mechanisms for the effective enforcement of them in the Gauteng Province.

Part 2: Noise Pollution Management

This chapter prohibits disturbing noise and noise nuisance and also provides for land use and the establishment of controlled areas.

Compliance Obligations?

Note the definition of “disturbing noise” and “noise nuisance” in the definitions section. You may not produce a disturbing noise or allow it to be caused by any person, animal, machine or any combination of them.

You may not use any loudspeakers or other amplifying instrument or allow any animal under your control to cause a noise nuisance. You may not make changes to or erect new buildings if such activity will or may cause a noise nuisance unless the local authority is first satisfied.

You may not drive or allow a vehicle to be driven on a public road if the sound level measured exceeds the SABS approved level. The local authority may instruct you to have the vehicle inspected or stop the vehicle and attach the vehicle until they have instructed you in writing to either repair the vehicle or have it inspected.
